Contract and Conditions of Carriage of Postal Articles

As of May 2008


Fastway Post New Zealand Limited and Obligations

a. Fastway Post New Zealand Limited (“Fastway Post”) is a registered postal operator in accordance with the Postal Services Act 1998 and the provisions of that Act apply to the provision of postal services operated by the carrier under the name Fastway Post New Zealand Limited (“the Carrier”).

b. Standard delivery times are displayed in the point of sale brochure available from the carrier's postal outlets and are subject to postal articles complying with the requirements specified in the point of sale literature.

c. Fastway Post New Zealand Limited will deliver with reasonable care and skill, correctly addressed fully postage paid postal articles that conform with the requirements specified in the point of sale literature.

d. Fastway Post New Zealand Limited will only accept goods for carriage if they are packaged in the standard Fastway Post packaging specified in the point of sale literature.


Delivery
e. A postal article shall be deemed to be delivered to the addressee when it is delivered by Fastway Post or its agents, at his or her house or office or into his or her letter box or rural delivery box, or into the addressee's property, to a private box at a Postal Outlet, to the addressee's employee or agent or other person considered to be authorised to receive the article, or according to the usual manner of delivery of postal articles to an addressee.

f. A postal article is also deemed to have been delivered when:
i. The consignee picks up the postal article from either of the carrier's postal outlets or from a sub-contractors or agents depot.
ii.When a signature required sticker has been purchased and is fixed to the postal article a signature will be obtained by the delivery courier. Once the signature has been obtained the goods will be deemed to be delivered.


Senders Obligations
g. The sender of a postal article expressly agrees:
i.Not to send any dangerous, illegal, hazardous or inadequately packaged postal article.
ii.To accept liability for any damage or loss resulting howsoever from the sending of any illegal, dangerous, hazardous or inadequately packaged article.
iii.Not to send cash, bank notes, coins, currency notes, stamps, deeds, travellers cheques, uncrossed cheques, credit cards, bonds, securities, shares, bullion, precious metals, stones or gems, jewellery, watches, antiques, works of art, fragile articles or send items valued over the sum of $250.00 except with the prior arrangement of Fastway Post New Zealand Limited.

h. That where postal services are used for business purposes neither Fastway Post New Zealand Limited nor its employees or agents shall bear any liability direct or consequential in respect of any loss, damage, delay or inability to deliver a postal article as a result of any acts or omissions negligent or otherwise.


Insurance
All postal articles carried by Fastway Post New Zealand Limited are governed by the Postal Services Act 1998.


Compensation
Other than in the event of a specific written agreement Fastway Post New Zealand Limited will pay up to N.Z. $250.00 (G.S.T. inclusive) compensation for loss or damage to postal articles during carriage, plus reimbursement of postage if lost. No compensation will be applicable for loss or damage to letters during carriage.
Fastway Post New Zealand Limited may elect at its sole discretion, to replace or reinstate the item rather than pay compensation.
In the event of compensation being paid in whatever manner Fastway Post New Zealand Limited has the right of disposal of the damaged item. In the event of loss Fastway Post New
Zealand Limited has the right in the event of the article being recovered to sell it with all proceeds being the property of Fastway Post New Zealand Limited.
Claims for compensation should in addition to the claim form have the following (if applicable):
a) Proof of Posting b) Invoices or Receipts c) G.S.T. number d) Value of item e) Tracking numbers


Exclusions
Compensation for damage or loss will not be paid for the following items without prior written agreement:

a. Cash, bank notes, coins, currency notes, deeds, travellers cheques, negotiable instruments and securities or bearer securities (including credit cards and uncrossed cheques).b .Bullion, precious metals, precious stones or gems.
c. Jewellery, watches or trinkets.
d. Antiques, paintings or pictures, works of art, sculptures.
e. Perishable goods, (foodstuffs subject to decay).
f. Inadequately packaged items.
g. Prohibited items, unlawfully posted or couriered items seized by Customs or the Ministry of Agriculture and Fisheries.
h .Loss or damage as a result of a force of nature or any other event beyond the control of Fastway Post New Zealand Limited
i. Loss of an incorrectly addressed item.
j. Any event following delivery.
k. Any claim for damage lodged more than 7 days after receipt.
l. Any claim for loss lodged more than 14 days from dispatch.
m. Any item that has a value greater than $250.00.
